Terms of Use

These Terms of Use (“Terms”) govern your access to and use of stillwellpsychiatry.com (the “Site”), operated by Stillwell Psychiatry, PLLC (“Stillwell Psychiatry,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Medical Emergency

If you are in crisis, do not use this website.

The Site is not for emergencies. If you are experiencing a psychiatric or medical emergency, having thoughts of harming yourself or others, or otherwise in crisis, call 911 or go to the nearest emergency room. You can also reach the 988 Suicide & Crisis Lifeline by calling or texting 988.

1. Acceptance of These Terms

By using the Site you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Site on behalf of another person, you represent that you are authorized to do so. We may amend these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent changes. Continued use of the Site after changes take effect means you accept the revised Terms.

2. Not Medical Advice

The content on the Site — including service pages, condition pages, blog posts, frequently asked questions, and any other text or media — is provided for general informational and educational purposes only. It is not medical advice and is not a substitute for diagnosis, treatment, or the professional judgment of a qualified clinician. Reading the Site does not establish a clinician-patient relationship between you and Stillwell Psychiatry, Rebecca Perry, APRN, PMHNP-BC, or any other provider associated with the practice. Never disregard professional medical advice or delay seeking it because of something you read here.

3. Clinician-Patient Relationship

A clinician-patient relationship is established only when you are formally accepted as a patient, complete required intake forms and consents, and attend a scheduled evaluation. Submitting the contact form, requesting an appointment through Zocdoc, or sending us an email does not create a clinician-patient relationship.

4. Telehealth Eligibility

Stillwell Psychiatry provides telehealth psychiatric care only to adults (18 years of age or older) who are physically located in the State of Florida at the time of the visit, in accordance with Florida Statutes Chapter 456, Part II (Telehealth) and applicable scope-of-practice rules. We do not provide care to patients located outside Florida or to minors. If you travel outside Florida, you must let us know so we can determine whether your appointment can proceed.

5. Appointments, Insurance, and Payment

Appointments are scheduled through Zocdoc, and use of Zocdoc is subject to Zocdoc’s own terms and privacy policy. Insurance coverage is verified by Zocdoc at the time of booking based on the information you provide; while we make every effort to display accurate in-network status, you are responsible for confirming coverage with your plan, and you are ultimately responsible for any cost-sharing amounts (copays, coinsurance, deductibles) or out-of-pocket charges.

For patients seen through Headway, insurance billing is handled by Headway, Inc., subject to their terms and privacy policy. Self-pay rates and any cancellation, no-show, or late-arrival policies will be disclosed before your first visit and may be updated from time to time.

6. Prescriptions and Controlled Substances

Whether and what to prescribe is a clinical decision made only after an appropriate evaluation. We do not prescribe medications based on contact-form messages or pre-visit requests. Controlled substances, including stimulants used in the treatment of ADHD, are prescribed in accordance with federal Drug Enforcement Administration regulations and Florida law, including the Florida Prescription Drug Monitoring Program (E-FORCSE), and may require additional evaluation, ongoing follow-up, and other clinical safeguards.

7. Use of the Contact Form

The contact form on the Site is for general, non-clinical inquiries. Do not use the contact form to share Protected Health Information, including symptoms, diagnoses, prescriptions, history, or test results. Communications submitted through the Site are not encrypted end-to-end and are not the appropriate channel for clinical communication. If you are an established patient, please use the secure communication method established with our practice.

We reserve the right to apply rate limits, block abusive IP addresses, and decline to respond to messages that are spam, abusive, harassing, or otherwise inappropriate.

8. Acceptable Use

You agree not to:

  • Use the Site in violation of any applicable law or regulation;
  • Attempt to gain unauthorized access to the Site, its servers, or any related systems or networks;
  • Probe, scan, or test the vulnerability of the Site or bypass any security or authentication measures;
  • Interfere with the operation of the Site, including by introducing viruses, malware, or other harmful code;
  • Use any robot, scraper, or other automated means to access the Site for any purpose without our express written permission;
  • Use the Site to harass, threaten, or impersonate any person; or
  • Submit content you do not have the right to share, or content that infringes the rights of others.

9. Intellectual Property

The Site — including its text, graphics, photographs, logos, page design, and underlying source code — is owned by Stillwell Psychiatry or its licensors and is protected by United States and international intellectual property laws. The names “Stillwell Psychiatry” and the Stillwell Psychiatry mark are owned by Stillwell Psychiatry. You may view and print pages of the Site for your personal, non-commercial reference. Any other use, including reproducing, modifying, distributing, or creating derivative works, is prohibited without our prior written consent.

10. Third-Party Services and Links

The Site links to and integrates with third-party services, including Zocdoc (booking), Headway (insurance billing), our review platforms, and others. We do not control those services and are not responsible for their content, practices, or terms. Your use of a third-party service is governed by that service’s own terms and privacy policy.

11. Reviews and Testimonials

Patient reviews displayed on the Site are sourced from third-party review platforms and are presented with the permission those platforms allow. Individual experiences are not predictions of outcomes. Mental-health treatment is personal, and what works for one patient may not work for another.

12. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Stillwell Psychiatry disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and availability. We do not warrant that the Site will be uninterrupted, secure, error-free, or that defects will be corrected. Nothing in this section is intended to disclaim any obligation owed to you in our capacity as a healthcare provider once a clinician-patient relationship has been established.

13. Limitation of Liability

To the fullest extent permitted by law, in no event will Stillwell Psychiatry, its members, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site — even if we have been advised of the possibility of such damages. Our aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100). Nothing in these Terms limits liability that cannot be excluded or limited under applicable law, including liability for professional services governed by Florida medical-practice statutes.

14. Indemnification

You agree to indemnify and hold harmless Stillwell Psychiatry and its members, employees, contractors, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Site is in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.

16. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stillwell Psychiatry regarding your use of the Site, and supersede any prior agreement on that subject. Our failure to enforce any provision is not a waiver of our right to do so later.
